These terms (“Terms”) apply to the entire contents of the Websites under the domain names www.maryglasgowmagazines.com, www.mgm-plus.com and www.maryglasgowplus.com (the “Website”) and to any correspondence by e-mail between us and you. Please read these Terms carefully before using the Website. Using the Website indicates that you accept these Terms regardless of whether or not you choose to register with us. If you do not accept these Terms, do not use the Website. This notice is issued by Mary Glasgow Magazines / Scholastic Limited (“Scholastic”).

1. INTRODUCTION

1.1 You may access most areas of the Website without registering with Mary Glasgow Magazines / Scholastic. Certain areas of the Website are only open to you if you register for a subscription or have a current subscription to one or more of our magazines.

1.2 By accessing any part of the Website, you shall be deemed to have accepted these Terms in full. If you do not accept these Terms in full, you must leave the Website immediately.

1.3 Mary Glasgow Magazines may revise these Terms at any time by updating this posting. You should check the Website from time to time to review the then current terms, because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages at the Website.

2. LICENCE

2.1 You are permitted to print and download news stories and resources from the Website for your own use to your personal computer or Apple Macintosh ® on the following basis: (a) no documents or related graphics on the Website are modified in any way; (b) no graphics on the Website are used separately from the corresponding text; and (c ) Mary Glasgow / Scholastic’s copyright and trademark notices and this permission notice appear in all copies.

2.2 If you are a registered subscriber you are permitted in addition, but subject always to complying with the conditions set out at clauses 2.1 (a) (b) and ( c) above, to: (a) download resources for use with your class to your own school laptop, classroom computers or computers in an ICT suite; and (b) display and/or run online resources on your interactive whiteboard or projector.

2.3 Unless otherwise stated, the copyright and other intellectual property rights in all material on the Website (including without limitation photographs and graphical images) are owned by Scholastic or its licensors. For the purposes of these Terms, any use of extracts from the Website other than in accordance with clause 2.1 for any purpose is prohibited. If you breach any of these Terms, your permission to use the Website automatically terminates and you must immediately destroy any downloaded or printed extracts from the Website.

2.4 Subject to clause 2.1, no part of the Website may be reproduced or stored in any other website or intranet or internet or included in any public or private electronic retrieval system or service without Scholastic’s prior written permission.

2.5 Any rights not expressly granted in these Terms are reserved.

3. SERVICE ACCESS

3.1 While Scholastic endeavours to ensure that the Website is normally available 24 hours a day, Scholastic shall not be liable if for any reason the Website is unavailable at any time or for any period.

3.2 Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Scholastic’s control.

4. VISITOR MATERIAL AND CONDUCT

4.1 Other than personally identifiable information, which is covered under our Privacy Policy, any material you transmit or post to the Website shall be considered non-confidential and non-proprietary. Scholastic shall have no obligations with respect to such material. Scholastic and its designees shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

4.2 You are prohibited from posting or transmitting to or from the Website any material:

(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or (b) for which you have not obtained all necessary licences and/or approvals, including photographic model releases; or© which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or (d) which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).

4.3 You may not misuse the Website (including, without limitation, by hacking).

4.4 Mary Glasgow / Scholastic reserves the right to monitor your use of the Website to ensure lawful use but have no obligation to do so.

4.5 Mary Glasgow / Scholastic shall fully co-operate with any law enforcement authorities or court order requesting or directing Scholastic to disclose the identity or locate anyone posting any material in breach of clause 4.2 or clause 4.3.

5. LINKS TO OTHER WEBSITES

5.1 Links to third party websites on the Website are provided solely for your convenience. If you use these links, you leave the Website. Mary Glasgow has not reviewed all of these third party websites and does not control and is not responsible for these websites or their content or availability. Scholastic therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Website, you do so entirely at your own risk.

6. CHATTER RULES

6.1 In consideration of your use of our, you agree to: (a) provide true, accurate, current and complete information about yourself when filling out our registration form; and (b) maintain and promptly update your registration data to keep it true, accurate, current and complete. If Scholastic has reasonable grounds to suspect that any information is untrue, inaccurate, not current or incomplete, Scholastic has the right to suspend or terminate your registration.

6.2 Your screen name will be used to identify you in Chatter. Vulgar or offensive names will constitute a breach of this clause 6.

6.3 If you are offended by another user’s screen name, please e-mail Scholastic at support@scholastic.co.uk immediately. Similarly if you are unsure about whether a username you would like to use may breach these clause 6, e-mail support@scholastic.co.uk for advice.

6.4 Mary Glasgow Magazines / Scholastic is concerned about the safety and privacy of all our users, particularly children and teenagers. Please remember that our chatter areas are designed to appeal to a broad audience. Accordingly, it is your responsibility to determine whether any use of the chat areas and our site is appropriate for your students / your child.

6.5 You understand that all data, text, software, music, sound, photographs, graphics, video, messages or other materials (“content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which the content originated. This means that you, and not Mary Glasgow Magazines / Scholastic, are entirely responsible for all content that you upload, post or e-mail via any forum and that written permission has been gained by you for their use on this website. Scholastic does not control the content posted via any forum and therefore does not guarantee the accuracy, integrity or quality of the content.

6.6 Under no circumstances will Mary Glasgow Magazines / Scholastic be liable in any way for any content, including (without limitation) any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of your use of any content. You agree that you must evaluate and bear all risks associated with the use of any content including any reliance on its accuracy or completeness.

6.7 You agree that you will not use any forum to: (a) upload, post or e-mail any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; (b) harm minors in any way; (c ) impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with a person or entity or disguise the origin of any content; (d) ‘stalk’ or otherwise harass another; (e) collect or store personal data about other users; (f) upload, post or e-mail any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships; (g) upload, post or e-mail any content that infringes any intellectual property rights of any party; (h) upload, post or e-mail any unsolicited or unauthorised advertising, promotional materials, ‘junk mail’, ‘spam’, ‘chain letters’, or any other form of solicitation; (i) upload, post or e-mail any content that contains computer viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment; (j) disrupt the normal flow of dialogue, cause a screen to ‘scroll’ faster than other users of the forum are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges; or (k) violate any applicable national or international laws or regulations.

6.8 You acknowledge that Scholastic does pre-screen content and that it shall have the right (though not the obligation) in its sole discretion to move, modify or remove any content that is available on or via any forum.

6.9 You grant to Scholastic a world-wide, royalty-free, irrevocable, non-exclusive licence (including the right to sub-license) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any content (in whole or part) you upload, post or e-mail and/or to incorporate such content in other works in any form, media or technology now known or developed.

6.10 You agree to indemnify and hold Scholastic and its subsidiaries, affiliates, employees, officers, agents or partners harmless from and against any direct or indirect loss or damage (including consequential loss and loss of profits, goodwill or business opportunities arising from any third party claim in relation to any content you upload, post or e-mail on or through the forums, your use of forums, or your breach of the provisions of this clause 6.

6.11 As soon as Scholastic is made aware of activities that breach this clause 6, prompt action will be taken. If you witness such breaches in the chat areas or anywhere else in our site, please email our forum team immediately.

6.12 On being made aware of any such breaches, Scholastic may ban, delete or prohibit any content that relates to those breaches or that it judges harmful to individuals or the rights of Scholastic or any of its affiliates, licensors or partners.

6.13 Scholastic reserves the right to take whatever action it deems necessary to prevent such breaches including the following: (a) breaches it deems minor may result simply in receipt of a warning from (address); or (b) breaches it deems serious may result in your automatic ban from the forums and the Website generally.

6.14 All incidents will be logged and our decision is final in all such cases. Any breaches may lead to Scholastic reporting your activities to your internet service provider, your employer, relevant authorities, or to legal action being taken against you, or both.

6.15 In addition Mary Glasgow Magazines / Scholastic may at any time move, modify or remove any content or take further legal action as a result of breaches or suspected breaches of these rules.

7. PROVISIONS APPLICABLE TO REGISTERED USERS

7.1 Each registration is for a single user only. Mary Glasgow Magazines / Scholastic does not permit you to share your user name (email) and password with any other person nor with multiple users on a network.

7.2 You shall at all times: (a) provide Mary Glasgow Magazines / Scholastic with accurate information about your identity; and (b) keep any username and password issued to you strictly confidential.

7.3 If at any time you are aware or suspect that any unauthorised use has or may have been made of your username or password you shall immediately notify Mary Glasgow Magazines / Scholastic by e-mail at support@scholastic.co.uk

7.4 Failure to comply with these Terms in full may result in the termination of your subscription.

8. DISCLAIMER

8.1 While Mary Glasgow Magazines / Scholastic endeavours to ensure that the information on the Website is correct, Mary Glasgow Magazines / Scholastic does not warrant the accuracy and completeness of the material on the Website. Mary Glasgow Magazines / Scholastic may make changes to the material on the Website, or to the products and prices described in it, at any time without notice. The material on the Website may be out of date, and Mary Glasgow Magazines / Scholastic makes no commitment to update such material.

8.2 The material on the Website is provided “as is”, without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, Mary Glasgow Magazines / Scholastic provides you with the Website on the basis that Mary Glasgow Magazines / Scholastic excludes all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill which, but for this legal notice, might have effect in relation to the Website.

9.1 Mary Glasgow Magazines / Scholastic, any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and any of Mary Glasgow Magazines / Scholastic’s group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Website or your downloading of any material from the Website or any websites linked to the Website.

9.2 Nothing in this legal notice shall exclude or limit Mary Glasgow Magazines / Scholastic’s liability for: (a) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977; or (b) fraud; or ( c) misrepresentation as to a fundamental matter; or (d) any liability which cannot be excluded or limited under applicable law.

9.3 If your use of material on the Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.

10. GOVERNING LAW AND JURISDICTION

10.1 This legal notice shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.


Terms and conditions applying to all competitions on the Mary Glasgow website

By submitting their entry entrants will be deemed to have agreed to be bound by these Rules. Entries through agents or third parties will be invalid.

1. To enter

Entries must be submitted no later than 11:59pm BST the closing date stated. Entries must be sent via the method explained in the competition. Entries sent by any other means cannot be permitted.

2. Announcement of winners

The winner will be notified personally within one week of the Closing Date. If a notified winner does not respond within 28 days of notification, another winner will be selected at random from the remaining eligible entries and contacted as previously stated. Once a subsequent winner has been selected, the previous winner’s entitlement to receive a prize will end.

3. Eligibility

The Prize Draw is open to all except those who are employees of [Scholastic Limited] (the “Promoter”), any of its wholly owned subsidiaries or any marketing services agency handling house or other company involved directly with the administration of this competition, or any member of their households.

4. Validity

Responsibility cannot be accepted for entries that are not received by the Promoters or for entrants who do not submit a correct email address. Correspondence will only be entered into at the absolute discretion of the Promoters.

5. Winner publicity

Entrants accept that, if they win, the Promoter will have the right, without additional payment or permission, to use their name and county of residence for the purposes of announcing the winners of this competition and for related promotional purposes.

6. Entries

All entries will become the property of the Promoter on its receipt of them and will not be returned.

7. Winning entry details

The name(s) of the winner(s) will be sent to anyone who writes within 3 months after the Closing Date, enclosing a stamped addressed envelope, to the following address:

8. The Promoter

9. Liability

To the fullest extent permitted by law, the Promoter excludes all liability howsoever arising in connection with the Prize Draw and the prizes and all warranties, conditions, undertakings, terms and obligations implied by law (whether by statue, common law or otherwise).

10. Applicable law

These terms and conditions will be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England.
